New Year 2023 Holiday List India: Public holidays in India in 2023 include Gazetted and Restricted days. Commercial establishments should be aware of the schedule for the states in which they are located.

The public holiday schedule for 2023 in India is divided into three categories, as is customary: gazetted, restricted, and state and union territory.

Many foreign human resource managers have difficulty adjusting to India’s holiday schedule. That is not surprising given that the federal and state governments recognise a number of holidays each month to accommodate over 1.3 billion people spread across 36 different states and union territories.

Overall, holidays in India are primarily governed by the following laws:

  • The Weekly Holidays Act, 1942;
  • The Industrial Employment (Standing Orders) Act, 1946;
  • The National and Festival Holidays Act, 1963;
  • The Negotiable Instruments Act 1981;
  • The Companies Act 2013; and
  • The Shops and Commercial Establishments Act.


The National & Festival Holidays Act, on the other hand, is applicable to all establishments in the country and mandates three Indian holidays: Republic Day, January 26; Independence Day, August 15; and Gandhi Jayanti, October 2. Regardless of whether a company, industry, or organisation follows the law, or whether they are public, private, or multinational corporations, every entity in India must remain closed on these days. Organizations that need to work on those days must obtain prior approval from the appropriate authorities.
