Following a directive from the Gauhati High Court, the case against Assam MLA Akhil Gogoi in connection with the state’s violent anti-CAA protests in 2020 was reopened.

However, the Supreme Court granted Assam MLA Akhil Gogoi immunity from arrest until February 24 in connection with the anti-CAA uprising and suspected Maoist links.

Because of the Supreme Court ruling, special NIA judge Pranjal Das postponed the hearing and scheduled it for February 28.

The Supreme Court has granted independent Assam MLA Akhil Gogoi bail in connection with a case involving anti-CAA protests and suspected Maoist links, and has requested a response from the National Investigation Agency (NIA) on his petition.

The lawmaker, who allegedly spoke out against the Central government during the anti-Citizenship Amendment Act protests, petitioned the Supreme Court in response to the Gauhati High Court’s February 9 order allowing the special NIA court in Assam to proceed with the framing of charges against him in one of the two cases.

The Gauhati high court granted the NIA permission to file charges against Assam MLA Akhil Gogoi and three others in the case on February 9.

Its decision came after the NIA filed an appeal in the Supreme Court challenging the special NIA court’s decision to clear Assam MLA Akhil Gogoi and three others.

Dhaijya Konwar, Bittu Sonowal, and Manash Konwar were the other three accused.

In 2021, In the second UAPA case filed against Sivasagar MLA Akhil Gogoi, a special NIA Court discharged him.

Akhil Gogoi has been cleared in the second of two UAPA cases filed against him for allegedly inciting violence during anti-CAA protests in Assam and a possible link to Maoists.

On June 25, he was acquitted in the first case.

The court released Gogoi after the NIA failed to establish his alleged links with Maoists.

The Chadmari Police Station in Guwahati registered the second UAPA case against Akhil Gogoi.
